Amazon Terms & Conditions

This platform is integrally connected with EarnKaro and as such, the terms and conditions of EarnKaro are to be read in conjunction with those provided herein. The services herein are rendered by EarnKaro (hereinafter referred to as the “Company”, “We”, “Us”, “Our”) and the Customer signing up and sharing/promoting the products/services or product category, provided by Amazon Seller Services Pvt. Ltd. are hereinafter referred to as the “User”, “You”, “Your”, “Publisher”. The Company and the User shall hereinafter be collectively referred to as “the Parties” and individually as “the Party” Please read these terms and conditions (“Terms and Conditions” or “Agreement”) carefully as they contain the legal terms and conditions setting forth the regulations to be adhered to by the User while sharing and marketing of the Amazon Seller Services Pvt. Ltd. (herein referred to as Amazon) products and Services on various social media platforms. By signing up on EarnKaro Amazon Affiliate Program, you agree to adhere by the following terms and conditions:

  1. The User must comply to the following terms:
    1. You must ensure complete accuracy and correct information during the sign-up process which allows Us to determine if You are eligible to share contents of Amazon through special links.
    2. The insights, opinions or perceptions shared about a product or a category listed on Amazon must be original and of your own. Such insight adds an extra value to the particular product or category, taking the customer’s attention.
    3. You must state with clear intentions while sharing deals of Amazon, that the particular link would redirect the customer to Amazon. These intensions may include words like “Buy on Amazon” or “Check price on Amazon”. The link must be accompanied with a text notifying where the link would send the User to.
    4. You must disclose accurately such information, as may be reasonably required by Us to ensure full compliance of the guidelines prescribed and to investigate and stop potential violating Users.
    5. You must while creating, sharing or posting an Amazon deal, ensure the accuracy and completeness to the material posted (including the product description or product category) which in-turns assists the end consumer in making a better purchase decision.
    6. The widget/linking tool/Associate tool provided by Us in order to share the Redistributable content, must be utilized to share limited amount of content and not any other content.
    7. You must either keep up to date or replace, the product advertising content, in case of a price fluctuation or any other reason within a 24-hour period or make sure to delete the post within the time frame in order to avoid sharing or promoting outdated content.
    8. You must keep your link sharing platform or the traffic source information up to date with the database provided to Us.
  2. The users must abstain to perform the following actions:
    1. Buy, either for reselling purposes or in bulk, from their own link for themselves or friends/family members.
    2. Driving traffic from unknown sources, or any source not shared with EarnKaro. You must be an owner or the individual responsible for the declared traffic source- WhatsApp/Telegram group.
    3. Using inappropriate/ foul/ misleading language while sharing/posting the special links.
    4. Infringing, violating or misappropriating Amazon’s rights or those of any other person or entity(including copyrights, trademarks, privacy, publicity or other intellectual property or proprietary rights). E.g., using words like “Amazon” or Amazon trademarked words in their channel(s)/group(s)/page name(s) or in the URL being used.
    5. Promoting hateful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, discriminatory, abusive, invasive material/posts along with the special links shared
    6. Promoting graphic sexual images and/or sexually graphic banner advertisements, or otherwise in any manner whatsoever
    7. Not to use any identical style and colour scheme of the Amazon site on your group logos or platforms where the special links are shared.
    8. Unapproved usage of Amazon marks, URLs, logos, Amazon web views
    9. Changing, modifying or altering in any manner Product Advertising Content.
    10. Using of screenshots of any Amazon products/ payment pages/ or other images.
    11. Displaying customer reviews in a manner violative of the terms & conditions mentioned on the Amazon site or sharing of modified reviews of the customers
    12. Using words like Loot, Bug, etc. which therein, reduces the authenticity and credibility of the posts or promotions being shared. Promotion of bugs on Amazon website is banned. Amazon reserves the right to reject orders if malpractices are detected.
    13. Displaying any misleading/incorrect product prices listed on Amazon portal. The User must not, store historical prices for the purposes of creating a price tracker which includes sharing screenshot of payment pages or adopting the use of price tracking websites.
    14. Storing, caching, or mentioning pricing content for more than 24 hours..
    15. Incentives offered to your users (e.g., group participants) for buying from your link in order to earn extra cashbacks etc.
    16. Enabling automatic redirection to Amazon’s site without clicking on the special link provided on the social media platform.
    17. Keeping the customer in delusion by misappropriating the link shared and hiding the link’s destination behind a text which states something like “Click here” or a button that states, “Check the price” and so forth. While sharing the link of any product or category listed on Amazon, the User must be direct and up-front to the audience being catered, informing them the landing page on clicking the link shared.
    18. Buying ads that link to Amazon Affiliate Link. This includes Facebook, YouTube, Google (AdWords and AdSense), or through an ad network. Any breach or non-adherence to the above terms mentioned, can attract disciplinary actions being taken against the Publisher, which includes blocking of the User’s account and thereby cancelling all the earnings in the said EarnKaro account.
  3. Applicability:

    All similar or other T&Cs mentioned in Amazon Associate’s Operating Agreement holds true for EarnKaro Amazon Affiliate Program as well.

  4. Information Privacy:

    The User declares that EarnKaro shall collect the User’s information such as Publisher’s name, Tracking ID(s), Contact details, Traffic Source and any other information required at the time of signup. We shall keep the provided credentials private and confidential from any third party but not including from Amazon in compliance with the terms agreed.

  5. Declaration:

    The User declares that the document containing the terms & conditions governing the relation with EarnKaro has been read, understood and accepted in its entirety and thus any violation to the said document can lead to cancellation of all profits and permanently blocking You from EarnKaro Amazon Affiliate Program.

  6. Communications:

    You hereby expressly agree to receive communications by way of SMS, e-mails, mobile app and browser notifications, and any other messages from time to time from EarnKaro, relating to change in instructions recently introduced or communicating Services provided through this Website.

  7. Changes to the Agreement:

    We reserve the right to occasionally make changes to this Agreement for valid reasons in order to improve the existing services rendered or adding new features or reasonable technical adjustments to the services provided or ensuring the operability and for legal or regulatory reasons. The amended version of this Agreement will be posted on the said platform and the new T&C will take immediate effect. In some cases, we will notify you in advance, and your continued use of the services either through App or website, after the changes have been made will constitute your acceptance of the changes. After posting the new version of the Agreement, it will immediately take effect and will govern the relationship between us:

    1. Commencing no less than three days after the date of posting (or such later date as we indicate in the relevant posting), if any of the changes is brought to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when the new version of the Agreement is to take effect, and from that date you must cease to use our service or
    2. Immediately upon the date of posting (or such later date as we indicate in the relevant posting), if the changes are not to operative provisions, or not capable of adversely affecting you – examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in this Agreement.
  8. Governing Law & Dispute Resolution:

    This Agreement, and our relationship with you, is governed as per the Indian Laws. We shall submit to the non-exclusive jurisdiction of the courts in Haryana in relation to disputes arising in connection with this Agreement.

    In the event of any claim, dispute or difference arising out of or in connection with the interpretation or implementation of this Agreement, or out of or in connection with any breach of alleged breach of this Agreement (“Dispute”) between the Parties hereto, then the parties shall first attempt to amicably settle the dispute failing which the same shall be referred to arbitration. The arbitration proceedings shall be governed by the Arbitration and Conciliation Act of 1996 or any statutory modification or re-enactment thereof for the time being in force (the “Arbitration Act”). Either Party to the dispute shall be entitled to apply to the appropriate court in India for interlocutory relief in respect of or during the course of the arbitration. The arbitration shall be held in Gurugram, Haryana

    All proceedings in any such arbitration shall be conducted in English.
